1. THIS CONTRACT is made between Cookequip Ltd of the one part (the seller) and of the other part (the buyer). a. By ordering from the Cookequip Ltd web site the buyer is accepting these Terms and Conditions in their entirety. b. The terms of this contract may be changed by Cookequip Ltd at any time, without notice, and the changes will be effective from the date of publication on the web site.
2. Delivery Regions a. Cookequip Ltd delivers mainly within the UK b. Deliveries to other destinations are made by special arrangement and are subject to higher delivery charges (see item 5.c. below)
3. Products a. All items are subject to availability. b. In the event that we are unable to supply an item we shall notify you as soon as is reasonably possible and offer an alternative where possible. If the alternative offered is unacceptable and you have already paid then we will reimburse your payment in full.
4. Payment a. All payments for the goods shall be made by the buyer on-line upon ordering by Credit or Debit Card payable to the seller or his lawfully authorised agent. b. Credit Card and Debit Card payments are made through the seller's lawfully authorised agents, NOCHEX, who will be responsible for the security of Credit Card payments.
5. Delivery Charge a. Prices displayed on the website do not include delivery. b. Our standard delivery charges are shown on the web site . c. For deliveries to parts of Scotland, Northern Ireland, or outside the UK, higher delivery charges apply and these are quoted on request.
6. Application of VAT a. The purchase price and delivery charge are inclusive of any VAT payable.
7. Guarantees a. All goods are warranted fit for their purpose under the normal sale of goods legislation applicable in England and Wales. b. Goods supplied will be covered by the manufacturer’s guarantee as appropriate. c. Goods will be insured by the seller during transit until the point of delivery.
8. Returns Procedures a. All goods are warranted fit for their purpose under the normal sale of goods legislation applicable in England and Wales. b. The borrower shall inspect the goods carefully upon receipt. Goods returned by the buyer to the seller must be returned by secure means within fourteen days of receipt with a note of the reason for the return. c. Goods returned by the buyer to the seller must be unused and returned in the original packing. d. The seller is not responsible for damage to goods returned by the buyer to the seller whilst the goods are in transit to the seller. The buyer must retain proof of return and the date thereof. e. Upon receipt of any returned goods, the seller will, subject to these full Terms and Conditions, refund to the buyer the purchase price, less the delivery charge and subject to a handling charge of 20% of the original purchase price.
9. Delivery a. Incorrect personal details may lead to problems or delays in delivery. The buyer shall ensure that the Seller is informed of the full delivery address, including an accurate postcode. b. The Seller will make delivery by post or by courier service. The charges for delivery by the seller will be the responsibility of the seller. c. Charges for delivery of returns by the buyer will be the responsibility of the buyer.
10. Insurance a. All goods delivered by the seller will be insured against loss during transit up to the point of delivery.
11. Delivery chasing enquiries a. If the buyer does not receive goods within two weeks of ordering, he must contact the seller by Email, telephone or fax. The seller will then establish the reasons for such delay and report back to the buyer with an explanation as soon as possible.
12. Data Protection a. The buyer is protected by the Data Protection Act. The seller does not make use of any information provided by buyers or purchasers for any purpose other than his own business. In particular, the seller does not provide information gained to any third party save for his lawfully authorised agent for collection of the purchase price in any case.
13. Bulk Email Policy a. The seller may from time to time, send to previous buyers information about goods including new products and special offers. If the buyer does not wish to receive such information, he may inform the seller.
14. Retention of Title a. Goods remain in the ownership of the seller until the point of delivery to the buyer.
15. Disclaimer a. The Seller shall be released from all obligations under these Terms and Conditions in the event of any cause beyond the Seller’s reasonable control which renders the provision of the web site or service impossible or impractical. b. The Seller is excluded from all liability for any claims, losses, demands and damages and any other consequential losses arising to person or property from or incidental to the use by the buyer of the goods purchased from the Seller and /or from any defects therein . The Buyer undertakes to exercise proper care in the use of any such goods purchased from the Seller and further indemnifies the seller against any claim for such losses demands and damages occasioned to the person or property of any third party as a result of the use by the buyer or such third party of the goods purchased from the seller. The information on the goods contained on this web site is based on the Seller’s present knowledge and experience and is given in good faith. However, no liability will accrue to the Seller in respect of and action taken by the buyer or any third party in reliance thereon. d. No waiver by the Seller of any breach of the Contract by the Buyer shall be considered as a waiver of any subsequent breach of the same or any other provision. e. If any provision of these Conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these Conditions and the remainder of the provision in question shall not be affected. f. Your statutory rights are not affected.
16. Mediation in case of dispute a. The seller has no specific procedure for mediation but is always conscious of the need, so far as possible, to retain good business relations with buyers and is always prepared o discuss with any dissatisfied buyer problems that may arise and, in appropriate cases, to consider an ex-gratia refund.
17. Applicable law a. This Contract shall be governed by the law of England and Wales.
